These Terms and Conditions ("Terms") govern your use of the Online Taxi Stand platform operated at onlinetaxistand.com ("Platform"). By using our Platform, you agree to these Terms. If you do not agree, please do not use our services.
1. Service Description
- ●Online Taxi Stand is a technology platform that connects passengers with independent driver-partners for shared intercity taxi travel across Northeast India.
- ●We are an aggregator under the Motor Vehicles (Amendment) Act, 2019. We are NOT a transport company and do not provide transportation services directly.
- ●We do not own, operate, or maintain any vehicles listed on the Platform.
- ●Drivers listed on the Platform are independent operators who use the Platform to find passengers for their intercity trips.
2. User Eligibility & Accounts
- ●You must be at least 18 years of age to use our Platform.
- ●One account per phone number. Duplicate accounts may be suspended.
- ●You are responsible for maintaining the security of your account credentials.
- ●Providing false, misleading, or fraudulent information is grounds for immediate account termination.
- ●Drivers must hold a valid Indian driving license, vehicle registration certificate (RC), comprehensive vehicle insurance, and valid pollution certificate (PUC).
3. Booking & Seat Selection
- ●Bookings are confirmed upon successful seat selection and payment processing.
- ●Each seat is individually priced. Seat prices may vary based on position (window, aisle, etc.).
- ●A confirmed booking reserves your specific seat(s) on the selected trip.
- ●Luggage allowance and pricing are set by the driver for each trip.
- ●Passengers must arrive at the designated pickup taxi stand at the scheduled departure time.
4. Cancellation & Refund Policy
Cancellation Timeline
- ●24+ hours before departure: Full refund of the booking amount.
- ●12-24 hours before departure: 75% refund.
- ●6-12 hours before departure: 50% refund.
- ●Less than 6 hours / No-show: No refund.
- ●Driver cancellation: Full refund to passenger + priority rebooking assistance.
- ●Trip cancellation by Platform: Full refund processed within 5-7 business days.
5. Payment Terms
- ●Seat booking amounts are paid online through our secure payment gateway.
- ●Additional charges (luggage, route changes) may be settled directly with the driver.
- ●All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes.
- ●Refunds are processed to the original payment method within 5-7 business days.
- ●We use PCI-DSS compliant payment processors. We do not store your card or UPI details.
6. Driver Obligations
- ●Maintain valid driving license, vehicle RC, comprehensive insurance, and PUC at all times.
- ●Provide safe, professional, and courteous service to all passengers.
- ●Follow all traffic rules and regulations. Ensure seatbelts are available and functional.
- ●Not operate the vehicle under the influence of alcohol, drugs, or any substances.
- ●Maintain the vehicle in safe, clean, and roadworthy condition.
- ●Arrive at the pickup taxi stand on time as per the scheduled departure.
- ●Report any accidents, incidents, or safety concerns to the Platform immediately.
7. Passenger Obligations
- ●Arrive at the designated pickup taxi stand at the scheduled time.
- ●Carry valid government-issued photo ID during travel.
- ●Behave respectfully towards the driver and fellow passengers.
- ●Not carry illegal, hazardous, or prohibited items in the vehicle.
- ●Comply with the driver's reasonable instructions regarding safety.
- ●Wear seatbelts at all times during the journey.
8. Limitation of Liability
Important Legal Disclaimer
Online Taxi Stand is a technology intermediary. We connect passengers with independent drivers. We do not provide transportation services.
- ●Online Taxi Stand is NOT liable for any accidents, injuries, death, or property damage occurring during trips booked through the Platform.
- ●Drivers are independent contractors, NOT employees of Online Taxi Stand. Drivers maintain their own motor vehicle insurance as required by law.
- ●Our liability is limited to the refund of the booking amount paid by the passenger in case of a service failure attributable to the Platform.
- ●We are not liable for delays, cancellations, or disruptions caused by weather, road conditions, traffic, strikes, natural disasters, or any force majeure events.
- ●Maximum aggregate liability of Online Taxi Stand shall not exceed the total booking amount paid by the user for the specific trip in question.
9. Dispute Resolution
- ●Step 1 — Support: Contact us at support@onlinetaxistand.com within 48 hours of the incident.
- ●Step 2 — Mediation: We will facilitate communication between the parties and attempt resolution within 5 business days.
- ●Step 3 — Arbitration: If unresolved, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
- ●Jurisdiction: The courts of Shillong, Meghalaya shall have exclusive jurisdiction over any disputes.
- ●Governing Law: These Terms are governed by the laws of India.
10. Intellectual Property
- ●The Online Taxi Stand name, logo, website design, and all associated content are our intellectual property.
- ●Users may not copy, modify, distribute, or create derivative works from any Platform content without written permission.
- ●User-submitted content (reviews, photos) remains the user's property but is licensed to us for display on the Platform.
11. Account Suspension & Termination
We reserve the right to suspend or terminate accounts for:
- ●Violation of these Terms or any applicable laws.
- ●Fraudulent bookings or payment chargebacks.
- ●Abusive or threatening behavior towards drivers, passengers, or staff.
- ●Providing false identity documents or information.
- ●Repeated no-shows or last-minute cancellations.
12. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated via the Platform or SMS. Continued use of the Platform after modifications constitutes acceptance of the updated Terms.
